General Conditions

General Travel Conditions

Dear customers: Please read the following General Conditions of Travel carefully. These conditions, from the moment they are effectively included, will form part of the travel contract from the moment of booking.

An informative brochure is understood to be the document in which the description of the package contained in the brochure that constitutes the object of the Package Travel Contract is incorporated.

It is considered as user or customer consumer/user/client, the natural or legal person who buys or commits to buy the package.

The information on the program/offer contained in the brochure is binding for the organizer and the retailer. The reservation of any of the trips included in this brochure implies the total acceptance of these general conditions, which are considered automatically incorporated into the contract, without the need for their written transcription in the same.

1 Application and formalization of the travel contract

1.1 With the reservation (booking request), the customer offers LOS18.ORG WORLD TOUR SL a binding offer to enter into a travel contract. This can be done in writing, verbally, by telephone or electronically (e-mail, Internet). The basis for this offer is the travel advertisement on this website with all the information contained therein, as well as these General Terms and Conditions of Travel.

1.2 The contract is only valid after LOS18.ORG WORLD TOUR SL has confirmed the booking in writing. The electronic confirmation of receipt of the travel request does not represent acceptance of the travel contract. In case of non-acceptance of the travel request, LOS18.ORG WORLD TOUR SL is not obliged to expressly explain the reasons to the customer or to justify the non-acceptance.

1.3 The customer is liable for all contractual obligations of his travel companions for whom he has booked as well as for his own, provided that he has assumed such obligation in a separate and express declaration.

1.4 If the content of the booking confirmation differs from the content of the request, LOS18.ORG WORLD TOUR SL must respect this new offer for 10 days. The travel contract is concluded on the basis of the new offer if the customer accepts this offer within this period by express declaration, down payment, remaining payment or commencement of the tour.

Legal framework applicable to the travel contract and acceptance of the General Conditions.

Applicable legislation

These General Conditions are subject to the provisions of the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007 of November 16, amended by Royal Decree Law 23/2018 of December 21, Law 7/1998 of April 13, on General Conditions of Contracting, and Decree 13/2011 of February 25, establishing the general provisions necessary to facilitate the freedom of establishment and provision of tourist services, the regulation of the responsible declaration, and the simplification of administrative procedures in tourism and Decree 6/2013, of February 8, on measures to simplify administrative procedures.

These General Conditions shall be incorporated signed by the contracting parties, as a sign of knowledge and acceptance by the consumer of each and every one of these conditions, to all travel contracts, whose object are the programs / offers contained in the program / brochure, and bind the parties, with the particular conditions that are agreed in the contract or contained in the travel documentation provided simultaneously with the signing of the contract. These General Conditions shall apply to those services provided for in Art. 151.1.a) of the aforementioned Royal Legislative Decree 1/2007.

It is considered that the package tour will start on the date and place where the services provided by LOS18.ORG WORLD TOUR SL begin. Air, land or sea transportation services, as well as accommodation services before or after the cruise, which are not contracted to LOS18.ORG WORLD TOUR SL, will be considered as single services when they are acquired through other Agencies.

The organization of this trip has been carried out by LOS18.ORG WORLD TOUR SL. with NIF: B02851996 with address at C/ Jaras, nº 9, 28238, Las Rozas de Madrid (Madrid, Spain).

2 Payment

2.1 After the formalization of the contract (receipt of the booking confirmation and payment of the pre-reservation fee of 50 euros) and the delivery of the guarantee certificate (by LOS18.ORG WORLD TOUR SL) the following payment schedule will apply:

Payment of 100% of the price from September 2021 and until December 31, 2021.

2.2 After full payment of the tour, the customer will immediately receive his travel documents.

2.3 Payment of the tour price must be made exclusively to LOS18.ORG WORLD TOUR SL until the due date indicated on the invoice and can be made from the website or via bank transfer to the account ES2700490919192110240391. Once payment has been made, it will no longer be possible to change the means of payment used.

2.4 LOS18.ORG WORLD TOUR SL is entitled to change the conditions of the contract, except for the price of the tour, after the conclusion of the contract as long as the change is irrelevant. This also applies in particular to changes in the sailing and stay schedules and/or routes (especially for safety or weather reasons), which are decided exclusively by the captain responsible for the vessel. LOS18.ORG WORLD TOUR SL will in such a case have to inform the customer about the change by means of a durable data carrier (paper or electronic) in a clear, understandable and visible manner.

2.5 If LOS18.ORG WORLD TOUR SL is only able to provide the booked tour under a substantial change of one of the main features of the tour or only under deviation from a contractual agreement additionally agreed between LOS18.ORG WORLD TOUR SL and the customer, LOS18.ORG WORLD TOUR SL is entitled to offer the customer a relevant change of contract or alternatively also the participation in another tour (substitute tour). In such a case, the customer is entitled to cancel the booked tour within a reasonable period of time set by LOS18.ORG WORLD TOUR SL without paying any compensation or to accept the offer of the contract change. If the guest does not speak to LOS18.ORG WORLD TOUR SL within the set period, the notified change is considered accepted.

2.6 Possible warranty claims shall remain unaffected if the changed services are defective. LOS18.ORG WORLD TOUR SL undertakes to inform the customer immediately of any differences in performance. In the event of substantial changes to the travel services with respect to the content agreed in the travel contract before the start of the trip, the customer shall be entitled to terminate the contract. The customer shall assert this right of termination against the organizer immediately after the declaration of the organizer.

2.7 Exclusions. The price of the Package Tour does not include:

Visas, airport taxes, and/or entry and departure taxes, vaccination certificates, "extras" such as coffees, wines, liquors, mineral waters, special diets - not even in the cases of full board or half board, unless expressly agreed otherwise in the contract -, laundry and ironing of clothes, optional hotel services, and, in general, any other service that is not expressly included in the section "The price includes" or is not specifically detailed in the program, in the contract or in the documentation that is delivered to the consumer when subscribing it.

Optional excursions or visits

In the case of optional excursions or visits not contracted at origin, it should be borne in mind that they are not part of the package travel contract. Their publication in the brochure is for information purposes only and the price is expressed as "estimated". Therefore, at the time of contracting them at the destination, there may be variations in their costs, which may alter the estimated price.

On the other hand, such excursions will be offered to the consumer with their specific conditions and final price independently, not being guaranteed until the moment of their contracting the possible realization of the same.

The price of the combined trip does not include gratuities or attentions to guides, porters or others at the destination.

  1. Withdrawal of the consumer and user (Article 160 of Royal Decree 1/2007 of the General Law for the Defense of Consumers and Users).

At any time the user or consumer may withdraw from the services requested or contracted.

In case of no-show at the departure, the consumer and user is obliged to pay the total amount of the trip, paying, where appropriate, the outstanding amounts unless otherwise agreed between the parties.

All these assumptions will be reviewed in case of force majeure.

  1. Modifications and termination of the contract for reasons attributable to the organizer or cancellation of the trip (Article 159 of Royal Decree 1/2007 of the General Law for the Defense of Consumers and Users).

In the event that the consumer and user chooses to terminate the contract, or that the organizer cancels the package tour before the agreed departure date, for any reason not attributable to the consumer and user, the latter shall be entitled, from the time that the termination of the contract occurs, to reimbursement of all amounts paid under the contract, or to the realization of another package tour of equivalent or higher quality provided that the organizer or retailer can propose it.

In the event that the trip offered is of lower quality, the organizer or retailer must reimburse the consumer and user, where appropriate in terms of the amounts already paid, the difference in price, according to the contract.

In any case, the consumer and user may demand the reimbursement of the amounts paid to the entrepreneur to whom they were paid, who must reimburse them within the terms and conditions provided for in Article 76. The calculation of the period, in this case, will start from the notification of the consumer and user of his option for the resolution or since the circumstances determining the cancellation occurred.

1.The same right foreseen in the previous number will correspond to the consumer and user who does not obtain confirmation of the reservation in the terms stipulated in the contract.

2.In the previous cases, the organizer and the retailer will be responsible for the payment to the consumer and user of the compensation that, in its case, corresponds for breach of contract, that in no case will be less than 5 percent of the total price of the contracted trip, if the mentioned breach occurs between the two months and fifteen days immediately previous to the foreseen date of realization of the trip; 10 percent if it occurs between the fifteen and three previous days, and 25 percent in the case that the mentioned breach occurs in the previous 48 hours.

3.There shall be no obligation to indemnify in the following cases:

4.a) When the cancellation is due to the fact that the number of persons registered for the package tour is less than the required number and the consumer and user is so informed in writing before the deadline set for this purpose in the contract, which shall be at least 10 days prior to the scheduled date of commencement of the trip.

5.b) When the cancellation of the trip, except in cases of overbooking, is due to force majeure, meaning those circumstances beyond the control of the person who invokes them, abnormal and unforeseeable whose consequences could not have avoided.

  1. Responsibility.

The organizer and retailer of the package travel shall be liable to the consumer, according to the obligations that correspond to them by their respective scope of management of the package, the proper performance of the obligations under the contract, regardless of whether they must perform them themselves or other service providers, and without prejudice to the right of organizers and retailers to act against such service providers.

The organizer and retailer of the package travel will be liable for the damages suffered by the consumer as a result of the non-execution or deficient execution of the contract. Such liability shall cease when any of the following circumstances occur:

1.That the defects observed in the execution of the contract are attributable to the consumer.

2.That such defects are attributable to a third party outside the supply of the services provided for in the contract and are of an unforeseeable or insurmountable nature.

3.That the defects are due to an event that the retailer or, where appropriate, the organizer, despite having taken all due care, could not foresee or overcome.

Limits of compensation for damages.

Regarding the limit of compensation for damages resulting from the non-performance or poor performance of the services included in the package, the provisions of the International Conventions on the subject shall apply.

  1. Other responsibilities

When the lack of connection of flights, even due to schedule changes of the participating airlines, requires an overnight stay or a long wait, the costs arising from this fact, both for accommodation and for meals and transportation will be borne by the air carrier causing the overbooking, cancellation or delay, in accordance with the provisions of EEC regulation 261/04, which establishes common rules on compensation and assistance to air passengers in cases of denied boarding and cancellation or long delay of flights.

The user has been informed of the peculiar characteristics of alternative travel, especially the climatic circumstances of the country of destination, the limitations of local professionals and the lack of matching the road, air and hotel infrastructure of the place with the conventional standard of Western countries.

The final itinerary detailed in the technical data sheet is for guidance only and all services included in the program must be confirmed in writing prior to payment of services.

The user also accepts the change of hotel establishment that occurs on the spot as long as the one enjoyed has a category or characteristics equal or superior to the one established in the initial itinerary.

Passports, visas and documentation.

All users, without exception (including children), must carry their personal and family documentation in order, whether passport or ID card, according to the laws of the country or countries visited. It will be at the expense of the users, when the trips so require, the obtaining of visas, passports, vaccination certificates, etc. In case of being rejected by any authority the granting of visas, for particular causes of the user, or being denied entry into the country for lack of the requirements that are demanded, or by defect in the required documentation, or for not being the bearer of the same, the organizer declines all responsibility for events of this nature, being borne by the consumer any expenses arising, applying in these circumstances the conditions and rules established for the cases of voluntary withdrawal of services.

Additional information to be provided to the consumer.

At the time of the formalization of the contract, the organizer or retailer will inform the consumer about the specific documentation necessary for the chosen trip and about the possibility of optional subscription of an insurance that covers cancellation costs and/or an assistance insurance that covers the costs of repatriation or transfer in case of accident, illness or death.

Likewise, the organizer will inform the consumer of the risks and health formalities implicit in the destination and the contracted trip, in compliance with the General Law for the Defense of Consumers and Users.

The agency will inform about the official documentation and the sanitary requirements necessary for the realization of the trip; however, it will be the sole and exclusive responsibility of the client both the formalization of the preceptive documents and the completion of the sanitary measures. In those cases in which the organizing agency is in charge of the processing of visas, the price of such management shall be separate from the price of the visa and the price of the trip and the organizing agency shall not be responsible for the fact that the documentation is lost or delayed due to causes beyond the agency's control.

The validity of the program will depend on the season in which the trip is requested.

Necessary Documentation and Health Documentation

Our services include the regulations valid for the trips specified in our catalog regarding the documentation required for entry into the country and health documentation at the time of closing the catalog.

We recommend, due to the constant variation of these regulations by the different countries, that before making your trip, you consult if there have been any changes in the level of documentation required for entry to the country and health documentation through the information on the website of the Ministry of Foreign Affairs, www.mae.es

7 Cancellation and termination by LOS18.ORG WORLD TOUR SL

7.1 LOS18.ORG WORLD TOUR SL reserves the right to terminate the travel contract before the start of the tour in the following cases:

(a) If the announced minimum number of participants expressly referred to in the relevant performance or trip description or other documentation that has become part of the contract is not reached, LOS18.ORG WORLD TOUR SL shall be entitled to cancel the relevant trip or trip performance up to 90 days before the start of the trip agreed upon in the contract. The customer must have received the information that the minimum number of participants has not been reached and of the cancellation of the tour or tour provision up to 90 days before the start of the contractually agreed tour. If the travel provision or the trip does not take place for this reason, the customer will receive a refund of the payment made for this travel provision or, in case of a trip cancellation, for the trip. b) If LOS18.ORG WORLD TOUR SL is prevented from fulfilling the travel contract due to unavoidable and exceptional circumstances; in this case, LOS18.ORG WORLD TOUR SL has to explain the cancellation immediately after learning the reason for the cancellation.

7.2 If the mental or physical condition of a client does not allow the realization of the trip or the continuation of the trip, because this makes the client unfit to travel or represents a danger to the client himself or to another person on board, the client may be refused transportation or the client's holiday trip may be interrupted at any time. LOS18.ORG WORLD TOUR SL is not responsible for any additional costs incurred. The same applies if a mental or physical disability requires special care for the client that goes beyond the contractually agreed LOS18.ORG WORLD TOUR SL services and the client does not have a companion to take care of him/her. In case of doubt, it is advisable to ask explicitly when booking.

7.3 LOS18.ORG WORLD TOUR SL has the right to terminate the travel contract if the customer carries on board weapons, ammunition, explosive or flammable substances and the like or commits criminal offenses. The contract may also be terminated for cause in the event of any attempt to do so.

7.4 The following on-board regulations shall apply and must be strictly observed and complied with by the customer. The client undertakes to follow all instructions concerning the boat's regulations given to him by the captain.

Among other things, violent, discriminatory, rude or verbally aggressive behavior will not be tolerated or accepted and may result in expulsion from the ship at the Captain's expense. In the interest of all customers, please observe the rules and regulations on board. Infringement and repeated non-compliance with the Captain's instructions, depending on the case and the seriousness of the infraction, may result in expulsion from the ship at the Captain's expense.

7.5 The Master is responsible for the vessel and the crew. He shall have the sole authority to make decisions regarding the nautical direction of the vessel, ensuring safety and compliance with the regulations on board and, in this capacity, shall have the right to expel the passenger from the vessel without compensation.

8 Cancellation by the customer

The customer can terminate the travel contract at any time before the start of the tour. The receipt of the declaration of cancellation by LOS18.ORG WORLD TOUR SL shall be decisive for this. The exercise of the right to reduce the price or claim for damages must be made exclusively against LOS18.ORG WORLD TOUR SL at the following address: info@Los18.org

LOS18.ORG WORLD TOUR SL will not be able to claim any compensation if exceptional and unavoidable circumstances occur at the vacation destination or in its immediate vicinity that significantly impair the realization of the trip.

LOS18.ORG WORLD TOUR SL has to provide the traveler with the trip booked free of any deficiencies. If the trip has any deficiencies, the client may demand LOS18.ORG WORLD TOUR SL to rectify them.

In the event that the client demands a correction, LOS18.ORG WORLD TOUR SL shall remedy the deficiency of the trip. LOS18.ORG WORLD TOUR SL may only refuse to remedy the deficiency if it is impossible or if it is associated with disproportionate costs taking into account the extent of the deficiency and the value of the travel service in question.

9 Change of booking/transfer of the contract

9.1 After the conclusion of the contract, the customer is not entitled to make any changes regarding the date of travel, place of departure or destination, accommodation or type of food, cabin or type of transport (rebooking). In any case LOS18.ORG WORLD TOUR SL will be open to discuss such changes.

9.2 The customer can declare to LOS18.ORG WORLD TOUR SL up to 90 days before the start of the tour that, in his place, a third party adheres to the rights and obligations arising from the travel contract. The declaration must be sent on a durable data carrier (paper or electronic) (email is recommended). LOS18.ORG WORLD TOUR SL has the right to object to the accession of the third party if the third party does not comply with the contractual travel requirements. If a third party joins the contract, he and the traveler are liable to the organizer as joint debtors of the travel price and additional costs incurred.

10 Liability/limitation of liability

10.1 The contractual liability of LOS18.ORG WORLD TOUR SL for damages other than bodily injury (also liability for breach of pre-contractual, ancillary or post-contractual obligations) shall be limited to three times the price of the tour insofar as the customer's damage was not caused by LOS18.ORG WORLD TOUR SL in a culpable manner.

10.2 Valuables for the purposes of the above must be transported in the hand luggage of the traveler in personal custody during the arrival and departure journey. LOS18.ORG WORLD TOUR SL is expressly not responsible for the loss or damage of valuables transported in checked baggage during the arrival and departure journey.

10.3 LOS18.ORG WORLD TOUR SL is not liable for deficiencies in services, personal injury and/or damage to property in connection with services that are not part of the contracted travel services, but are services provided by third parties independently (e.g. public transport, sporting events, visits to theaters and exhibitions).

10.4 LOS18.ORG WORLD TOUR SL recommends that clients take out travel accident insurance and luggage insurance in their own interest.

11 Medical care on board

The vessels are equipped with modern medical care facilities located on deck 3. Highly qualified on-board doctors and specialist staff are available to provide you with medical care. Consultation hours will be notified on board. Customers undergoing medical treatment or who have special concerns should inform the onboard physician at the beginning of the voyage. Please note that the services of the doctor on board are not part of the travel contract and that medical decisions made by the doctor on board are not subject to the instructions of LOS18.ORG WORLD TOUR SL. Extensive medical treatment can only be provided on board to a certain extent. If you suffer from chronic or serious illnesses, please contact LOS18.ORG WORLD TOUR SL prior to booking to discuss whether it is possible for you to participate in a LOS18.ORG WORLD TOUR SL trip and to arrange the framework conditions. The medical treatment is offered against payment (invoicing through the on-board invoice). You will receive a detailed invoice from the doctor on board after your visit to the hospital. It will not be possible to invoice via the health card or the health booklet for travel abroad). At the end of your trip you will receive an itemized bill from the hospital, which you can send to your health insurance company abroad for reimbursement. We therefore strongly recommend that you take out health insurance abroad. In case of risk, the patient may be disembarked at the nearest port. The costs of disembarkation and medical treatment are to be borne by the patient. As far as possible, LOS18.ORG WORLD TOUR SL will provide assistance through an agency in case of medical disembarkation. For disposal of medical waste (insulin syringes, etc.), please contact the hospital on board. If you need special medication, please bring it on board in sufficient quantity in your hand luggage. Please note, however, the EU directive regarding the carriage of liquids in hand baggage, as well as any import or customs restrictions of the relevant destination country.

12 Passport, visa and health regulations

12.1 The client must comply with all laws, regulations, ordinances and travel rules (directives) of the countries and ports included in the tour, as well as with all rules and instructions of LOS18.ORG WORLD TOUR SL.

12.2 The customer is responsible for obtaining and carrying the travel documents required by the authorities, any necessary vaccinations as well as for compliance with customs and currency exchange regulations. Any expenses incurred in this respect shall be borne exclusively by the customer. All inconveniences resulting from non-compliance with these regulations, e.g. payment of cancellation costs, penalties, fines and other expenses or any other additional travel expenses, shall be borne by the customer.

12.3 The client must provide LOS18.ORG WORLD TOUR SL with all personal data (detailed data) required for the trip in question at least 90 days before the start of the trip and ensure that the specified data corresponds to the data in the travel documents (e.g. passport and identity card).

12.4 LOS18.ORG WORLD TOUR SL is not responsible for the timely issuance and access to visas or other necessary travel documents by the competent authority (e.g. diplomatic representation) if the customer has commissioned LOS18.ORG WORLD TOUR SL to acquire them, unless LOS18.ORG WORLD TOUR SL has culpably violated its own obligations.

13 Data protection/image rights

13.1 The personal data provided within the framework of your booking (e.g. name, address, telephone number, etc.) will be stored, processed and used for the purpose of processing the trip and for customer service. In addition, the data may be used to send updated information and offers by post or e-mail. If you do not wish to receive this information, please let us know by contacting: info@Los18.org

13.2 During the trip, LOS18.ORG WORLD TOUR SL may take photographs and make audio and video recordings in the public areas of the ship. By formalizing the travel contract, the client consents to the taking and editing of such photographs. The client also consents to unlimited use of the photographs in terms of time, space and content as long as they are used in the context of a cruise. Clients who do not wish to be photographed or filmed may inform the camera crews present.
